Definitions

In these Terms, the following capitalized terms have the meanings set out below unless the context otherwise requires:

• "User" means any person who accesses or uses the Services.
• "Content" means any text, images, audio, video, or other material submitted, posted, or displayed by Users.
• "Staff" means administrators, moderators, and other personnel authorized to operate or moderate the Services.

Community Status

The Trail Roleplay is an informal, volunteer-run community of individuals. It is not incorporated or otherwise recognized as a formal legal entity, and does not maintain a dedicated legal team. All community operations, including enforcement of these Terms, are managed by volunteers in good faith and in accordance with applicable law.

Permitted Use & User Obligations

Users shall use the Services only for lawful and permitted purposes and in accordance with these Terms and any posted rules or policies. Users must not:

• engage in harassment, hate speech, or threats;
• exploit or distribute unauthorized modifications, cheats, or hacks;
• impersonate Staff or other users; or
• take any action that materially disrupts the Services or other users' enjoyment of the Services.

Enforcement, Sanctions & Appeals

Staff may investigate alleged breaches of these Terms and apply sanctions where appropriate, including warnings, temporary suspensions, permanent bans, and content removal. Enforcement actions are at Staff's discretion and intended to preserve the integrity and safety of the community.

Where an appeal process exists, it will be described in the relevant rules or communicated by Staff. Abusive or frivolous appeals may be rejected and may result in further action.

Donations, Purchases & Refunds

Any donations, purchases, or paid offerings are voluntary and non-binding. Unless expressly stated otherwise, contributions are non-refundable. Paid items, benefits, or privileges may be modified, suspended, or revoked at any time without liability.

Third-Party Services

The Services rely on third-party platforms and providers (including, without limitation, game platform operators, hosting providers, and Discord). We do not control such third parties and are not responsible for their actions, omissions, terms, or policies. Users are encouraged to review third-party privacy policies and terms prior to use.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, The Trail Roleplay, including its volunteers, officers, and affiliates, shall not be liable for any direct or indirect loss, damage, or harm arising from your use of the Services, including but not limited to lost characters, items, or progress. All use of the Services is at your own risk.

Indemnification

Users agree to indemnify, defend, and hold harmless The Trail Roleplay, its volunteers, officers, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from or relating to your breach of these Terms, your Content, or your use of the Services.

Termination

We reserve the right to suspend or terminate access to all or part of the Services for any reason, including breaches of these Terms or conduct detrimental to the community. Termination does not relieve users of obligations incurred prior to termination.

Copyright & Intellectual Property

The Trail Roleplay and its licensors retain all right, title, and interest in and to the Services and all related intellectual property. Users retain ownership of their Content but grant The Trail Roleplay a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display such Content for the purpose of operating and promoting the community.

The Trail Roleplay is an independent, fan-run community and is not endorsed by or affiliated with Rockstar Games, Take-Two Interactive, or any other rights holders. All third-party marks remain the property of their respective owners.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdictions set out below, without regard to conflict of law principles except where a specific matter or processing activity is governed by another jurisdiction's mandatory rules:

• United States of America: Primary governing law for the Service and its operations.
• Finland: Applicable to matters concerning hosting, server operations, and infrastructure.
• Other jurisdictions: Local data protection and storage rules may apply and will be complied with as required.

Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.
